Terms of Service

1. General Provisions

These Terms of Service ("Terms") govern the use of domain name registry services ("Services") operated by XSR Corporation ("the Company"). Accredited registrars ("Registrars") and domain name registrants ("Registrants") must agree to these Terms before using the Services.

The Company provides the Services as an ICANN-accredited registry operator, in accordance with the ICANN Registry Agreement.

2. Description of Services

  • Processing of top-level domain (TLD) registrations, renewals, transfers, and deletions
  • Operation of authoritative DNS servers and zone file management
  • WHOIS/RDAP service provision
  • EPP (Extensible Provisioning Protocol) gateway provision
  • DNSSEC signing services
  • OT&E (Operational Test and Evaluation) environment for registrars

3. Domain Name Registration

3.1 Registration Process

Domain name registration is conducted through registrars accredited by the Company. The Company does not accept domain name registration applications directly from registrants.

3.2 First-Come, First-Served

Domain name registrations are accepted on a first-come, first-served basis, except during priority registration periods such as Sunrise.

3.3 Accuracy of Registration Information

Registrants warrant that registration information provided through their registrar is accurate and current. If inaccurate registration information is identified, the Company reserves the right to suspend or delete the domain name in accordance with ICANN policies.

3.4 Registration Period and Renewal

Domain name registration periods range from 1 to 10 years. Renewal must be completed through the registrar before the expiration date. After expiration, ICANN's Redemption Grace Period (RGP) applies.

4. Prohibited Activities

  • Use in connection with phishing, malware distribution, or other cybercrime
  • Use primarily intended for sending spam email
  • Use in connection with botnet command and control
  • Distribution of child sexual abuse material
  • Attacks or attempted attacks against the Company's DNS infrastructure
  • Any other use that violates applicable laws or public order

If DNS Abuse is confirmed, the Company reserves the right to suspend, delete, or change the status of domain names without prior notice, in accordance with the ICANN contract and registry policies.

5. DNSSEC

The Company implements DNSSEC signing for all TLDs it operates. Registrars and registrants are responsible for managing DS (Delegation Signer) records. KSK (Key Signing Key) rollovers are performed in accordance with procedures established by the Company.

6. Dispute Resolution

6.1 UDRP

Domain names registered under gTLDs operated by the Company are subject to ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP). Trademark holders may initiate dispute resolution proceedings through an ICANN-accredited dispute resolution provider.

6.2 URS

New gTLDs operated by the Company are subject to the Uniform Rapid Suspension System (URS). The Company will take swift action to suspend domain name use based on URS determinations.

6.3 Registry Execution

Upon finalization of a dispute resolution decision, the Company will execute the transfer, cancellation, or other necessary measures for the domain name as determined.

7. Service Level

The Company provides Services in compliance with the service level requirements set forth in the ICANN Registry Agreement:

  • DNS Resolution Service: 99.99% availability
  • EPP Service: 99.99% availability
  • RDAP/WHOIS Service: 99.99% availability
  • DNS Response Time: under 500ms (UDP)

8. Limitation of Liability

The Company provides the Services on an "AS IS" basis. To the maximum extent permitted by law, the Company shall not be liable for:

  • Damages arising from DNS failures, network failures, or other technical issues
  • Disputes between registrants and third parties arising from domain name use
  • Indirect, consequential, special, or punitive damages
  • Damages arising from force majeure events (natural disasters, war, terrorism, cyberattacks, regulatory changes, etc.)

The Company's liability shall in no event exceed the amount of the registration fee for the relevant domain name for the most recent one-year period.

9. Indemnification

Registrants shall indemnify and hold the Company harmless from any claims made by third parties against the Company arising from the registration and use of domain names, and shall compensate the Company for any damages incurred (including attorney's fees). This includes disputes related to trademark infringement, issues arising from inaccurate registration information, and damages resulting from violations of these Terms.

10. Modifications

The Company may modify these Terms due to changes in law, ICANN policy revisions, or other reasons. For material changes, notice will be provided at least 30 days before the effective date via the Company website and notification to registrars. Continued use of the Services after the effective date constitutes acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising from these Terms.
